The Federal Energy Regulatory Commission (FERC) has opened the scoping period for an environmental review of the Dearborn County Lateral Project, a set of natural gas facilities proposed by Texas Gas Transmission, LLC. The project would touch three counties:
- Dearborn County, Indiana
- Boone County, Kentucky
- Hamilton County, Ohio
FERC staff will use the resulting environmental document to help the Commission decide whether the project meets the public convenience and necessity standard required for a certificate. The scoping notice asks the public and interested agencies to weigh in on the project's potential environmental effects, reasonable alternatives, and measures to avoid or lessen those impacts.
Comments are due in Washington, DC by 5:00 p.m. Eastern time on July 27, 2026, under docket No. CP26-536-000. Anyone who filed comments with the Commission before it opened that docket on May 29, 2026, must refile them in CP26-536-000 for the Commission to consider them. The Commission accepts comments through its eComment and eFiling tools on its website, or by mail.
Landowners along the route may hear from a Texas Gas representative about acquiring an easement for construction and operation. They are not required to sign an easement agreement, but if the Commission approves the project, the Natural Gas Act gives the company the right of eminent domain, and a court would set compensation under state law if the two sides cannot reach a deal.
